Sadly, Benjamin Paul Frazier, a convicted felon, had no business carrying a firearm in any respect--concealed or otherwise. Court records show an entry that the defendant was in a "medically induced coma" from injuries sustained in the incident and had been booked at the county jail "in absentia" and just physically transported there this past Sunday. The man accused of shooting and murdering 40 year old Kenneth Brown outside of Drai's nightclub at Bally's Las Vegas Hotel & Casino on October 21st is still being held without bail at the Clark County Detention Center in Las Vegas. Benjamin Paul Frazier, age 41, just had his first hearing yesterday in the Las Vegas Justice Court where the judge saw him unworthy of having a bail amount set in court. He is accused of first degree murder, two counts of attempted murder, and carrying a concealed weapon without a permit (by a prohibited person). Frazier had a 1997 felony conviction of assault with a deadly weapon prior to this crime. The defendant allegedly confronted nightclub management about getting a $30 covercharge refund before the shooting erupted. A nightclub manager and security officer were wounded by gunfire but survived. Kenneth Brown, reportedly a heroic "good samaritan" was killed tragically however. Without regarding his own safety witnesses say he attempted to thwart the shooter and subdue him. He was shot in the process.
